City offices brace for summary demolition of illegal structures

Concerned city government offices have been ordered to adopt measures that will ensure the immediate removal of illegal structures constructed on titled properties and safeguarded and protected lands in the city.

Mayor Mauricio Domogan met with City Planning and Development Officer Evelyn Cayat, City Building Official Nazita Bañez, City Assessor Maria Almaya Adawe, City Engineer Edgar Victorio Olpindo, the city legal team led by City Legal Officer Melchor Carlos Rabanes, and the City Anti-Squatting and Illegal Structures Committee secretariat to firm up strategies to fast-track the removal of the illegal structures.

It has been agreed upon that the City Engineer will only issue the clearance on road right-of-way (ROW) whether or not the lot applied for by an individual for titling falls within the ROW of city or barangay roads. It is not within the jurisdiction of the said office to conclude whether or not such lot is no longer needed by the city for its public requirements.

The City Engineering Office was also tasked to ensure that the measurement of city and barangay roads conforms with prescribed standards so that there will be no deviations in the measurement of roads in the different parts of the city that allow titling applicants to encroach on the RROW.

Domogan agreed with the suggestion that there should be a map showing the city’s road network and its metes and bounds to make it easier for concerned offices to determine encroachments.

The City Anti-squatting and Illegal Structures Committee secretariat was requested to fast-track the issuance of summary demolition orders for ongoing illegal construction and not to wait for the structure to be completed before demolition.

The measurement of the road ROW was earlier based on the edges of titles issued to property owners, but some of them allegedly extended their properties and encroached in the road ROW. 

Technical personnel of the concerned offices were tasked to conduct ocular inspection of the lands  where there are applications and assure ROW are not encroached upon.
